Prom night is a special night that most teens look forward to at the end of the school year. It’s an opportunity for teens to dress up, hang out with friends, dance the night away and stay out past curfew. Parents are right to be concerned knowing that alcohol also plays a role in this special night and often leads to a high risk of teens involved in drunk driving accidents in Dallas.

Dallas personal injury lawyers know that drunk driving should not be the only concern of parents. The influence of alcohol can be deadly in other ways as well. CBS DFW reports about the recent death of a teen following prom night at Dallas Skyline High School. The young man was found dead in his hotel room after attending a post-prom party with friends. It is believed he died of alcohol poisoning.
160351_students_prom.jpg
It shouldn’t come as a surprise that April, May and June are the deadliest months for teen drivers in Texas and nationwide. With prom, end-of-year parties, and graduation all occurring during this time period, these events tempt teens to consume alcohol before getting behind the wheel.

National Highway Traffic Safety Administrationreports that approximately 6,000 young people are killed each year by teens consuming alcohol. Alcohol consumption is responsible for 60 percent of all teen deaths in car accidents. More than 30 percent of teenage drivers involved in fatal crashes are tested with a blood alcohol concentration of .08 or higher at the time of the crash. Roughly 60 percent of juniors and seniors admit to riding in a car with a teen driver who is under the influence of alcohol and 80 percent say they took their first drink by the age of 16. Approximately 75 percent of teens drink at parties hosted by other teens.

There are some things as parents that you can do to help the situation. Communication is the first step.

Mothers Against Drunk Driving National President Laura Dean-Mooney states “Research has shown that parents are the number one influence in their child’s decisions about drinking, so MADD is eager to get the conversation about alcohol started in households across the country — particularly in advance of prom and graduation season.”

Dallas was one of few cities to host the Power of Parents program in April that brought together communities, educators, government, and law enforcement officials to show support and awareness for underage drinking prevention. This was in conjunction with the U.S. Senate declaring April 21st as PowerTalk 21 day, a day dedicated nationally to communicating with your kids about the dangers of alcohol, specifically on prom night.

Parents who struggle with this topic should approach the subject by explaining the health risks involved with drinking alcohol, the long-term effects it can have, the importance of leading a healthy lifestyle and how making smart choices can lead to a lifetime of opportunities for your teen.

The Texas Confederation of Motorcycle Clubs started a program eight years ago, urging all motorcyclists to ask that city officials throughout the state issue a proclamation to recognize May as Motorcycle Safety and Awareness Month, according to the Alvin Sun.

They started out with seven city proclamations in 2003 and now have nearly 200 cities and more than 10 counties participating. Texas Governor Rick Perry also issued a proclamation in 2010 to help reduce the risks of a motorcycle accident in Dallas and elsewhere in the state.
985274_speed.jpg
Our Dallas injury lawyers urge motorcyclists to join the efforts of this year’s safety awareness month; attend council meetings and other awareness events to help keep our roadways safer and accident free.

According to the Texas Department of Transportation (TexDOT), the number of registered motorcycles in Texas more than doubled over the last ten years from more than 180,000 in 2000 to more than 424,000 in 2010.

In 2010, More than 37,000 beginner and advanced students went through the Texas Motorcycle Operator Training Program courses. A 5 to 20 percent discount was offered by most motorcycle insurance companies for completing the safety course, according to Hill Country Times.

The main message of this year’s Motorcycle Safety and Awareness Month asks that motorists take a second look before pulling out into traffic, changing lanes or crossing through intersections. Nearly every day there are reports of accidents and fatalities involving a motorcyclist.

Motorcycle events will be held statewide throughout the month, like the one that was held last week at Texas State Technical College (TSTC), according to the Valley Morning Star.

“With gas prices going up, we’ve heard from dealerships that they’ve seen an increase in motorcycle sales,” said Angie Gonzalez, TSTC’s continuing education director .

Because motorcycles are much smaller than other vehicles, drivers may have a difficult time judging the distance and speed of an approaching motorcycle. This is why drivers involved in crashes with motorcycles often claim that they never saw the motorcyclist and is why they were unable to react in time to prevent the accident, according to TexDOT.

The Texas’ “Share The Road” campaign asks all motorists to look twice for motorcyclists — because seeing them is saving them:

-Look twice, especially at intersections, entering traffic or when changing lanes. Clearly signal your intentions to alert motorcyclists of you movement.

-Have respect. Remember that a motorcycle has the exact same rules, privileges and regulations as every other motorist.

-Give them space. Don’t tailgate as their riding patterns are not always steady. Riders often swerve and veer within traffic lanes to avid road debris and to steer clear of strong traffic winds.

-Be cautious of their reactions in varying weather conditions. Motorcycles take a much longer distance to stop on wet pavement.

-Keep out of their lane when riding next to them as well. They deserve a full lane just as you do.

If you or a loved one has been involved in a motorcycle accident, contact Dallas Personal Injury Lawyer Mike Goolsby of The Goolsby Law Firm for a free and confidential consultation to discuss your rights. Call (972) 492-8758.

A new survey released by the AAA Foundation for Traffic Safety reports that most Americans would prefer that government officials take more action in improving highway safety to decrease risks of a car accident in Dallas and elsewhere. The survey appears just in time for the global kickoff of the ‘Decade of Action on Road Safety’, put on by the United Nations.

Dallas injury attorneys would like to remind motorists to practice safe driving habits at all times. Everyone is asked to join the global campaign as it aims to reduce the number of highway deaths and injuries worldwide.
768180_urban_traffic.jpg
“Despite shrinking federal and state transportation budgets and a public debate over the most appropriate role of government, it’s clear that a majority of Americans want government officials to do more – not less – about highway safety,” said AAA President and CEO Bob Darbelnet. “From passing and enforcing laws about teen drivers and distracted driving to programs that improve the safety of our roadways and add safety equipment to vehicles, there are many steps government can take reduce crashes, injuries, and deaths in the U.S.”

The campaign, more specifically, aims to stabilize and reduce global road deaths by 2020. Numerous major economies of the G20, the United States, public institutions and other developing countries, endorse the Decade of Action.

“At a time when more and more U.S. highway safety agencies are adopting “Toward Zero Death” goals, it is very heartening to see motorist support for more, not less action by government to make our roads safer,” added J. Peter Kissinger, President of the AAA Foundation for Traffic Safety, that commissioned this survey.

Decade of Action campaign tools can be found on their website to help you spread the word and to help get your loved ones and community involved in the cause.

Roughly 1.3 million people are killed, and approximately 50 million are injured, on roads worldwide each year. Many of those injured remain disabled for the rest of their life. Approximately 90 percent of casualties from roadway deaths happen in developing countries. Yearly road accident deaths are expected to reach nearly 2 million people by 2020.

In 2008, there were nearly 50,500 motor vehicles involved in fatal accidents in the United States. More than 25,000 passenger vehicle occupants died in these traffic crashes, and an estimated 2.35 million were injured. Texas experienced nearly 2,500 traffic accident fatalities the same year, according to the National Highway Traffic Safety Administration.

A passenger was fortunate enough to survive a Dallas car accident after a rollover SUV crash blamed on a driver using his cell phone, according to My Fox DFW.
1131636_no_cells.jpg
Dallas County Sheriff’s Deputies report that the driver had just left the bar with his buddy and that alcohol may have also played a role in the single-car wreck.

Our Dallas car accident attorneys urge drivers to focus on the road when operating a motor vehicle and to avoid distractions at all cost as they can cause serious injury to you, your passengers and other motorists. With a recent wave of technology, driving while engaging in distracted behavior has become all too common.

The accident happened at roughly 2:30 a.m. as the driver was leaving Highway 67 to head eastbound on I-20. He was reportedly on his phone when he lost control of his vehicle, stuck a tree and flipped his SUV. The vehicle reportedly landed face-down in a body of water.

Luckily a passing motorcyclist stopped to assist the victims. He pulled them out of the vehicle and called for help. The motorcyclist says that the driver was drowning.

Emergency responders rushed both of the occupants to the hospital, where the driver was later pronounced dead. The passenger has been treated and released from the hospital.

In the wake of an increased rate of distracted driving accidents, the U.S. Department of Transportation is leading the effort to help Americans put down the distractions while behind the wheel. The government is working with a number of public and private entities to raise awareness and to tackle the dangerous habit.

Distracted driving is more prominent than you may think. A recent survey conducted by Distraction.gov found:

-Nearly 5,500 people were killed in 2009 in the United States because of motor-vehicle accidents that reported to have involved distracted driving. An additional 448,000 were injured in the same types of accidents.

-Approximately 20 percent of all crashes resulting in injury reported distracted driving in 2009.

-Drivers using a hand-held device behind the wheel are four times more likely to be involved in an accident serious enough to cause injury.

-Of the fatal distracted-driving-related accidents, nearly 1,000 of them reported the use of a cell phone as the distraction.

-Young drivers under the age of 20 are the ones most likely to be involved in distracted driving accident. Nearly 20 percent of these young drivers have been involved in one of these accidents.

-The use of a cell phone behind the wheel gives a driver the same reaction time as one who is legally drunk (with the blood alcohol concentration of .08).

Distracted driving involves any non-driving activity that a person engages in that can have the ability to take their attention off of the road and increase their risks of being involved in an accident.

A head-on car accident in Texas took the life of an East Texas toddler this past weekend, according to CBS 19. The driver of the other vehicle, a young 16-year-old, was reportedly on his way home from work and might have fallen asleep behind the wheel.

The accident happened just north of Golf road in Gilmer on Highway 155. The parents of the three-year-old and their 3-month-old daughter were in the vehicle during the accident and were not injured. The driver of the other vehicle only suffered minor injuries.

Dallas car accident attorneys urge driers to be aware of the effects of driving drowsy. The best prevention against drowsy driving accidents is to avoid them all together and stay where you are instead of getting behind the wheel of a vehicle and endangering the lives of you and other motorists.

The boy was transported to Children’s Medical Centerin Dallas, on his third birthday, and later pronounced dead.

“When you are behind the wheel of a car, being sleepy is very dangerous. Sleepiness decreases awareness, slows reaction time, and impairs judgment, just like drugs or alcohol, contributing to the possibility of a crash,” said AAA Foundation President and CEO Peter Kissinger. “We need to change the culture so that not only will drivers recognize the dangers of driving while drowsy but will stop doing it.”

It’s reported that two out of every 5 drivers, or 41 percent, confess to haven fallen asleep behind the wheel at one point or another. One in ten admits to being guilty of the act at least once in the last year, according to a AAA Foundation for Traffic Safety study. More than a fourth of those surveyed admit to driving while experiencing difficulty staying awake and difficulty keeping their eyes open during the last month.

“Many of us tend to underestimate the negative effects associated with fatigue and sleep deprivation and, conversely, overestimate our abilities to overcome them while driving,” said Kathleen Marvaso, vice president, AAA Public Affairs. “This data underscores the importance of educating drivers on the simple, yet effective steps they can take to prevent a possible tragedy. Unfortunately, too many drivers have adopted the ‘I’m tired, but I can make it’ mentality, often to their own peril or to the peril of others.”

Nearly 90 percent of surveyed drivers found it completely unacceptable for a person to operate a motor vehicle if they’re so tired that they’re having trouble staying awake. Unfortunately, sometimes a driver may try to push through fatigue.

“It is shocking to consider that one quarter of drivers admit to operating a vehicle in the last month in an incapacitated state.” The National Sleep Foundation has been championing better drowsy driving awareness and education since 1991. Cloud adds, “We applaud AAA’s work to elevate this issue for public scrutiny and action,” says David Cloud, CEO of the National Sleep Foundation.

New data, provided by the National Highway Traffic Safety Administration, estimated that more than 16 percent of deadly motor-vehicle accidents and one in eight accidents that result in vehicle-occupant hospitalization involve a drowsy driver.

If you believe you might be getting sleepy behind the wheel, the AAA Foundation urges you to pull over and rest, drink a caffeinated beverage or switch with a passenger and allow them to drive while you rest. These preventative measures can be used to keep you, and other motorists, safe on our Texas roadways.

The Goolsby Law Firm is dedicated and motivated to fighting for victims and their families who have suffered in Dallas, Carrollton or the surrounding areas. If you or a loved one has been injured in an accident with a drowsy driver or any other car-related accident, call for a free consultation at 1-972-394-2141.

An extra day for travel makes a world of difference getting to and from where you need to go, so Memorial Day weekend road trips are common.

Despite high prices at the gas pump, AAA Auto Club is predicting most Texans will travel by car this weekend, according to My San Antonio. The risk of a car accident in Dallas and elsewhere throughout the state is much higher considering 88 percent of travelers in Texas will be driving this weekend.
566449_stop_light.jpg

The National Safety Council estimated 366 traffic fatalities in 2009 when the actual number recorded during the holiday weekend period was 462. This Memorial Day holiday period (starting Friday at 6 p.m. and ending Monday at 11:59 p.m.), the National Safety Council (NSC) is predicting 39,400 injuries in traffic crashes and another 406 traffic-related fatalities.

Memorial Day weekend is one of the deadliest weekends of the year. NSC also says that if all passengers were to wear their seat belts this weekend, more than 100 lives could be saved nationally.

In 2009, the National Highway Traffic Safety Administration reported 32 fatal crashes in Texas on Memorial Day. There were 80 deaths reported in the state on that day alone in 2009.

Texas law enforcement will be patrolling areas for all sorts of traffic violators this weekend. Kicking off its 11th year, the Texas Department of Public Safety will enforce a zero tolerance for seat belt laws throughout the state in recognition of the national Click It or Ticket campaign.

“State law requires everyone in the vehicle to be restrained no matter where they are seated,” said Assistant Director David G. Baker, who is the Chief of the Texas Highway Patrol. “Seat belts save lives, and that is the primary reason to buckle up, but we will have a zero-tolerance policy during this period, and violators will be ticketed if need be.”

Fines for failing to wear a seat belt can range up to $250 plus court costs throughout the state. The zero tolerance policy will be enforced starting Monday, May 23, through Sunday, June 5.

Travel tips to remember as you head out for day trips or a weekend get-away this holiday weekend:

-Don’t drink and drive. Alcohol consumption has a direct effect on a driver’s ability to react and make decisions.

-Maintain a safe travel speed, especially when roadways are congested.

-Plan to take alternate routes with less traffic congestion or travel during non-peak hours of the day.

-Put your cell phone out of reach so you are not tempted to respond to incoming calls or text messages.

-Make sure you and all passengers are safely secured before putting the car in drive.

Texas led the nation in the number of hyperthermia deaths for small children left alone in vehicles in 2010. Our state can get pretty hot during the summer months, so the National Highway Traffic Safety Administration wants to remind school employees, daycare centers, babysitters and parents who drive with small children not to leave them in the car alone to reduce the risk ofhyperthermia or heat stroke accidents in Dallas and elsewhere throughout the state.

Dallas injury lawyers know the fragility of small children can lead to serious heat-related injuries or illnesses when left in a car considering temperatures usually gauge many degrees hotter inside the vehicle than outside. Heatstroke usually occurs when body temperature surpasses 104 degrees. Symptoms can include dizziness, hallucinations, distress, lethargic behaviors, fast heart rate or hot dry skin that is flushed but not sweaty. Children can’t regulate their internal thermostat as easily as adults, so their temperatures warm as much as three- to-five times faster than an adult’s.
825531_closed.jpg

Safe Kids USA, the General Motors Foundation and other partners are teaming up to educate and bring awareness about the dangers of leaving children in vehicles in an effort to prevent heat-related deaths. Coalitions throughout the country and in Austin know the importance of this issue and will share prevention messages as well as post advertising campaigns on billboards, radio announcements, web banners and print ads. Tips to prevent heat-related illnesses and deaths will also be available.

“We’re launching this program in Austin because the statistics for Texas are alarming,” said Major Ron Joy, Highway Patrol, Texas Department of Public Safety. “Though Texas has a law addressing children unintentionally left in a car, Texas had 13 deaths in 2010, more deaths than any other state in the nation. In fact, one in every seven child deaths for heat stroke occurred in Texas since recordkeeping began. Together, we must work to help eliminate these tragedies.”

The Department of Geosciences reports that from 1998 2010, there were 497 hyperthermia deaths of children left in cars; 71 of these fatalities were reported in Texas. Last year there were 49 in the U.S., and already this year there have been three reported fatalities. The first death this year occurred in Southeast Texas, and the most recent fatality occurred less than a week ago in Kentucky.

Safe Kids USA tips for preventing hyperthermia accidents for children left in vehicles include:

-Never leave a child in a vehicle alone, even with the air on or windows cracked. If you see a child in an unattended vehicle, call 911 or local emergency services for help.

-Place an important item like a purse, briefcase or cell phone on the backseat floor in front of your child so you remember they are with you.

-Set up a daily reminder on your cell phone or computer to remind you to drop off your child at daycare.

-Never allow children to play alone in vehicles, especially at home. Always lock the vehicle after exiting and make sure the keys are left out of reach of small children.

-If a child comes up missing, check your vehicle inside (including the trunk) and out first because children find them to be great hiding places.

Texas is one of 19 states that have a law in place to prevent leaving a child in an unattended vehicle. A recent study showed that charges were filed in 49 percent of deaths related to hyperthermia, and 81 percent resulted in convictions. If your child has been left in a vehicle by a babysitter, childcare provider, or daycare center you should contact an attorney right away to pursue legal action.

First off, the number one most dangerous roadway for a teen to drive on is Interstate 45 in Harris County as it recorded the most teen accidents. This road has more car accidents involving teen driver than any other road in Texas. These figures were taken from the data recorded between 2006 and 2010. This data of teen car accidents in Texas was recorded by Allstate Insurance for the Texas Department of Transportation (TxDOT).
78228_em_slick_2.jpg
Statistically speaking, teenage drivers are more likely to be involved in traffic accidents anyway, but where they are driving can also play a part.

Roads can be more dangerous for a number of reasons. Danger can increase with the traffic flow, with the road design or with merely the time of day you travel on these roads. Our Dallas personal injury attorneys recognize that the best thing to do for our young drivers is to educate them and teach them the cautious and proper ways to navigate our roadways. With the proper guidance, we can help to decrease the risks of fatal accidents for our teen drivers.

According to the data released by Allstate and TexDOT, Interstate 10 ranks second for logging the most teen accidents in Texas. This interstate is in Harris County as well, making the top two roads located in one area. Interstate 10 in Bexar County ranks third on that list.

The data also points out that the most dangerous time of the year for teen drivers is the time between Memorial Day and Labor Day — commonly referred to as the “100 Deadliest Days.” More teens die in car accidents during these 100 days than any other time of the year,

According to the National Highway Traffic Safety Administration, in 2008 there were more than 208 million licensed drivers here in the United States. Drivers between the ages of 15 and 20 made up more than 6 percent, or 13.3 million, of that total.

In the United Stated in 2009, nearly 2,500 of these young drivers were killed in traffic accidents. Another 196,000 young drivers were injured in these motor-vehicle accidents in the same year.

Texas witnessed nearly 600 teen deaths from motor-vehicle accidents in 2009.

With the proper practice and education, we can help to prepare our young drivers for the dangers they will face on our potentially dangerous roadways.

These are the top 5 motor-vehicle accidents by roadways and county involving drivers between the ages 15 and 19 from 2006 to 2010 in Texas:

Roadway/County – Total Crashes

1. I-45 Harris County – 3,091

2. I-10 Harris County – 1,910

3. I-10, Bexar County – 1,727

4. I-35, Bexar County – 1,668

5. SL1604, Bexar County – 1,648

Newly released data from Transportation for America illustrates the number of pedestrian fatalities on America’s roadways from 2000 to 2009. In this time there were more than 47,000 people killed, and another 688,000 injured, in motor-vehicle related pedestrian accidents. The 2011 edition of the pedestrian accidents in Dallas and elsewhere through the country is accompanied byDangerous by Design 2011, which is an examination of the problem and a number of solutions for the preventable epidemic.
1100586_safe_walk.jpg
Our Dallas pedestrian accident attorneys understand that roadway and driving safety needs to be evaluated to help to keep our on-foot travelers safe. It has been proven that most of these pedestrian accidents occur along “arterial” roadways that have been engineered solely for speeding traffic with no concern for pedestrians of any sort.

The newly released edition of this national report comes with a fact sheet for all 50 states, which includes their statistic for pedestrian fatalities from 2001 to 2009. Specific location data and an interactive map can be used to find out which roads are safe and just how unsafe the more dangerous ones are.

According to Dangerous by Design 2011, Texas ranks 9th in the nation for the most dangerous roadways. Between 200 and 2009, Texas say more than 4,200 pedestrian fatalities on our roadways. These accidents cost the state more than $18 billion.

It’s surprising that a portion of our federal tax dollars are supposed to go towards the streets to help them to be more pedestrian friendly, yet they continue to be designed to be perilous to older adults, children and pedestrians of all ages. As a matter of fact, Congress is currently considering totally eliminating the funding for such projects.

Among the most vulnerable were those over the age of 75.

The following counties were ranked as the most dangerous areas in the state:

-Harris, 755 pedestrians deaths.

-Dallas, 522 pedestrian deaths.

-Bexar, 315 pedestrian deaths.

-Tarrant, 258 pedestrian deaths.

-Travis, 161 pedestrian deaths..

Lobbyists for highway funding continue to insist that pedestrian safety needs to be the responsibility of local governments. This really makes no sense considering nearly 70 percent of the pedestrian fatalities that occurred over the past 10 years happened on federal-aid roads.

Under these federal guidelines, state governments are encouraged to prioritize speeding traffic over the safety of pedestrians. Safety advocates argue guidelines and funding should benefit the safety of everyone.

Making a roadway to be pedestrian friendly is actually pretty cheap. Pedestrian project only cost consumers less than 1.5 percent of the current federal transportation outlay. This is the 1.5 percent that Congress is looking to eliminate.

Residents are urged to contact Congress and voice your concerns on the elimination of the federal funding used to increase pedestrian safety. Simply type in your zip code on the website to ensure that you message makes it to the right recipient.

Just hours after this new report was released, Senator Tom Harkin and eleven co-sponsors formally introduced the Complete Streets Act of 2011. This act requests that streets be created equal, safe and accessible for all users, whether on foot, in a wheelchair, on a bike or using public transit.

If you or a family member is hurt in a Dallas pedestrian accident, contact Dallas Injury Attorney Mike Goolsby for a free and confidential consultation to discuss your rights. Call (972) 394-2141. Serving Dallas, Carrollton and the surrounding areas.

It’s summer, and that means our teens are out of school for the next few months. That also means they’re more likely to be involved in a deadly car accident in Dallas and elsewhere throughout the country.

According to Mothers Against Drunk Driving, teen drivers are now facing the 100 deadliest days on our roadways. Nine of the 10 deadliest days occur between the months of May and August.
887960_rider.jpg

Our Dallas personal injury lawyers understand that teens are looking forward to a summer full of fun and are not focusing on school, homework or other responsibilities. Many of them may not be focusing on road safety either. Motor-vehicle accidents rank as the number one killer for teens in our country. One out of three of these fatal accidents is alcohol-related.

According to the National Highway Traffic Safety Administration, the United States had nearly 2,500 teen fatalities because of motor-vehicle accidents in 2009. Another 196,000 teens were injured in these accidents. This means that 11 percent of all drivers that were involved in a fatal accident that year was a driver 15 to 20 years old.

Young drivers made up nearly 6.5 percent, or 13.3 million, of all licensed drivers in the U.S. that year. That’s a more than 5 percent increase from 1999.

Texas had nearly 200 fatalities occur from motor-vehicle accidents that involved a teen driver in 2009.

Partners for Safe Teen Driving offers these tips to help parents keep their young ones safe on our roadways:

-Be sure that the vehicle your teen is driving is in good working condition.

-Cap the number of passengers that your teen driver may drive with. This lowers the chances of distracted-driving-related accidents.

-Limit the number of evening hours that your teen can drive. Help them make other arrangements if they need to travel at night.

-Prepare them for our roadways by giving them plenty of supervised experience.

-Lead by example. Always be on your best behavior when your child is riding along with you.

-Try establishing a parent-teen driving agreement between the both of you to lay down ground rules behind the wheel.

-Make sure they put down the cell phone while driving.

-Train them to drive in poor weather conditions.

With the help of parents, we can aim to reduce teen traffic-related deaths during the upcoming summer months.

The Goolsby Law Firm is dedicated and motivated to fighting for victims and their families who have suffered in Dallas, Carrollton or the surrounding areas.
